NEW YORK CITY INDUSTRIAL DEVELOPMENT AGENCY

NOTICE OF PUBLIC HEARING

The New York City Industrial Development Agency (the “Agency”) is empowered under the New York State Industrial Development Agency Act (constituting Title 1 of Article 18-A of the General Municipal Law), and Chapter 1082 of the 1974 Laws of New York, as amended, to issue nonrecourse revenue bonds to provide financing for qualified projects, and to enter into industrial and small industry incentive program transactions and other straight-lease transactions for the benefit of qualified projects, and thereby advance the job opportunities, general prosperity and economic welfare of the people of the State of New York (the “State”) and to improve their prosperity and standard of living.  The Agency has been requested (i) to make available the proceeds of its bonds to be issued in the approximate aggregate dollar amounts, to be used by the persons, for the purposes, and at the addresses identified below, and (ii) to participate in industrial and small industry incentive program straight-lease transactions and other straight-lease transactions for the purposes and at the addresses also identified below.  As used herein, “bonds” are bonds, the interest on which may be exempt from local and/or State and/or Federal income taxes; and the “City” shall mean The City of New York.  As used herein with reference to bond amounts, “approximately” shall be deemed to mean up to such stated bond amount or a greater principal amount not to exceed 10 % of such stated bond amount.

Approximately $2,700,000 industrial development revenue bond transaction for a real estate holding company to be determined for the benefit of Agostino Antiques, Ltd., a furniture manufacturer, in connection with the construction, furnishing, and equipping of an approximately 65,000 square foot building located on a approximately 35,395 square feet of land located in Staten Island, New York, Block 7206, Lots 191 and 196.  The financial assistance proposed to be conferred by the Agency will consist of such bond financing, payments in lieu of City Real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

Approximately $5,000,000 civic facility revenue bond transaction for A Very Special Place, Inc., a not-for-profit agency serving individuals with developmental disabilities, in connection with the acquisition, construction, furnishing and equipping of an approximately 20,000 square foot building located on an approximately 19,343 square foot parcel of land located at 634 New Dorp Lane, Staten Island, New York, Block 4043, Lot 115.  The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Approximately $1,228,000 civic facility revenue bond transaction for  Human Care Services, Inc., a provider of habilitation services for people with developmental and mental disabilities, in connection with the acquisition, renovation, equipping, furnishing, and/or refinancing of an approximately 2,680 square foot parcel of land and an approximately 1,300 square foot building located at 218 Avenue N, Brooklyn, New York. The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Straight-lease (Industrial Incentive Program) transaction for IBK Enterprises, Inc. or an affiliate thereof, a fabricator and distributor of rebars and construction related metal supports in connection with the acquisition of approximately 26,000 square feet of land at 498 Johnson Avenue, Brooklyn, New York, Block 2993, Lot 11,  and the construction and equipping of an approximately 20,000 square foot building located thereon. The financial assistance proposed to be conferred by the Agency will consist of payments in lieu of City real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

Approximately $1,230,000 civic facility revenue bond transaction for Independence Residences, Inc., a provider of habilitation services for people with developmental disabilities, in connection with the acquisition, renovation, furnishing, equipping, and/or refinancing of facilities at the following addresses:  (i) an approximately 2,000 square foot parcel of land and an approximately 1,983 square foot building located at 33-23 69th Street, Woodside, Queens, New York (approximate cost - $630,000); and (ii) an approximately 3,200 square foot parcel of land and an approximately 2,895 square foot building located at 108-14 Metropolitan Avenue, Forest Hills, Queens, New York (approximate cost - $600,000). The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Approximately $2,640,000 industrial development revenue bond transaction for a real estate holding company to be determined for the benefit of Katz Metal Fabricators, Inc., a sheet metal fabricator, in connection with the acquisition, renovation, furnishing and equipping of an approximately 23,343 square foot building located on an approximately 50,151 square foot parcel of land located at 434 East 165th Street, Bronx, New York.  The financial assistance proposed to be conferred by the Agency will consist of such bond financing, payments in lieu of  City real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

Approximately $5,005,000 civic facility revenue bond transaction for Lifespire, Inc., a provider of day and residential habilitation services for people with autism and developmental disabilities, in connection with the acquisition, renovation, equipping, furnishing, and/or refinancing of facilities at the following addresses: (i) an approximately 5,966 square foot parcel of land and an approximately 2,529 square foot building located at 247-22 88th Road, Bellerose, Queens, New York (approximate cost - $510,000); (ii) an approximately 3,990 square foot parcel of land and an approximately 2,622 square foot building located at 141-55 256th Street, Rosedale, Queens, New York (approximate cost - $408,000); (iii) an approximately 3,745 square foot parcel of land and an approximately 3,233 square foot building located at 2262 Loring Place, Bronx, New York (approximate cost - $720,000); (iv) an approximately 4,750 square foot parcel of  land and an approximately 2,500 square foot building located at 5121 Oceanview Avenue, Brooklyn, New York (approximate cost - $650,000); (v) an approximately 2,200 square foot parcel of land and an approximately 2,012 square foot building located at 1116 East 232nd Street, Bronx, New York (approximate cost - $550,000); (vi) an approximately 2,507 square foot parcel of land and an approximately 3,975 square foot building located at 4705 Osman Place, Bronx, New York (approximate cost - $555,000); (vii) an approximately 6,931 square foot parcel of land and an approximately 2,282 square foot building at 602 Britton Avenue, Staten Island, New York (approximate cost - $510,000); and (viii) an approximately 1,664 square foot parcel of land and an approximately 4,165 square foot building located at 538 West 156th Street, New York, New York (approximate cost - $1,100,000). The financial assistance proposed to be conferred by the Agency will consist of such  bond financing and exemption from City and State mortgage recording taxes.

Approximately $1,500,000 civic facility revenue bond transaction for Martin de Porres School for Exceptional Children, Inc., a provider of a special education, in connection with the lease, renovation, furnishing, equipping and/or refinancing of a portion of an approximately 140,231 square foot parcel of land and an approximately 16,500 square foot building located at Bishop Ford High School, 500 19th Street, Brooklyn, New York. The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Up to $15,000,000 civic facility revenue bond transaction for New York Institute of Technology, a not-for-profit New York educational corporation providing undergraduate, graduate and professional degrees in more than 100 majors, in connection with the construction, renovation, equipping and upgrading of a combined building of approximately 83,575 square feet on an approximately .26 acre lot located at 1855 Broadway and 1849 Broadway, New York, New York and of a portion of a combined building of approximately 45,000 square feet on an approximately 10,000 square foot lot located at 21 West 61st Street and 16 West 61st Street, New York, New York.  The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Straight-lease (Industrial Incentive Program) transaction for a real estate holding company to be determined for the benefit of Old Williamsburgh Candle Corp., a candle manufacturer, in connection with the financing and/or refinancing of the construction, renovation, furnishing and equipping of an approximately 37,000 square foot building located on an approximately 40,000 square foot parcel of land located at 141-143 Alabama Avenue (a/k/a 317 Glenmore Avenue), Brooklyn, New York and an approximately 41,600 square foot building located on an approximately 35,000 square foot parcel of land located at 300 Liberty Avenue, Brooklyn, New York.  The financial assistance proposed to be conferred by the Agency will consist of payments in lieu of City real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

Straight-lease (Industrial Incentive Program) transaction for a real estate holding company to be determined for the benefit of Peter Cosola Inc., a manufacturer of architectural moldings, facades, doors and cabinets, in connection with the financing and/or refinancing of the acquisition, construction, renovation, furnishing and equipping of an approximately 13,000 square foot building located on an approximately 14,133 square foot parcel of land located at 45-57 Davis Street, Long Island City, Queens, New York.  The financial assistance proposed to be conferred by the Agency will consist of payments in lieu of City real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

            Approximately $6,750,000 straight-lease (Small Industry Incentive Program) transaction for  English Kills Realty LLC  for the benefit of UB Distributors, LLC, an alcoholic beverage distributor, in connection with the acquisition, renovation, new construction, furnishing and equipping of the following sites: an approximately 61,285 square foot parcel of land located at 1213-1217 Grand Street, Brooklyn, New York and an approximately 151,665 square foot parcel of land located at 1245 Grand Street, Brooklyn, New York, and  the interconnected buildings thereon of approximately  37, 500 square feet and 66,200 square feet, respectively, together with an access easement over an approximately 14,200 square foot parcel of vacant land located on Grand Street, Brooklyn, New York. The financial assistance proposed to be conferred by the Agency will consist of payments in lieu of  City real property taxes, exemption from City and State mortgage recording taxes, and exemption from City and State sales and use taxes.

Approximately $9,500,000 civic facility revenue bond transaction for the benefit of an entity to be formed by Vocational Instruction Project Community Services, Inc., a not-for-profit multi-services agency, in connection with the acquisition, renovation, furnishing and equipping of an approximately 66,467 square foot building located on approximately 8,769 square feet of land at 1910 Arthur Avenue, Bronx, New York, Block 2947, Lot 14.  The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Approximately $1,200,000  civic facility revenue bond transaction for Women’s League Community Residences, Inc., a provider of habilitation services for people with developmental disabilities, in connection with the acquisition, renovation, furnishing, equipping and/or refinancing of an approximately 3,750 square foot parcel of land and an approximately 3,600 square foot building located at 674 East 2nd Street, Brooklyn, New York. The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Approximately $660,000 civic facility revenue bond transaction for Young Adult Institute, Inc., a provider of habilitation services for people with developmental disabilities, in connection with the acquisition, renovation, furnishing, equipping and/or refinancing of an approximately 6,000 square foot parcel of land and an approximately 3,835 square foot building located at 110-56 67th Drive, Forest Hills, Queens, New York. The financial assistance proposed to be conferred by the Agency will consist of such bond financing and exemption from City and State mortgage recording taxes.

Pursuant to Section 859a of the General Municipal Law of the State of New York and Internal Revenue Code Section 147(f), the Agency will hold a hearing on the proposed financings and transactions set forth above at the office of the New York City Industrial Development Agency, 110 William Street, 6th Floor, New York, New York commencing at 10:00 A.M. on Monday, October 7,  2002.  Interested members of the public are invited to attend.  The Agency will present information at such hearing on the proposed financings and transactions set forth above.  Pursuant to subdivision 3 of the above-referenced Section 859a, the Agency will, in addition, provide an opportunity for the public to review at such hearing the project application and the cost-benefit analysis for each of the proposed financings and transactions.  Persons desiring to make a brief statement regarding the proposed financings and transactions should give prior notice to the Agency at the address or phone number shown below.  Written comments may be submitted to the Agency at the address shown below.
